SECTION 1 — GENERAL CONDITIONS

Destined Design Agency reserves the right to refuse or discontinue services where permitted by applicable law.

All clients and website visitors are expected to use our website responsibly and conduct business interactions professionally.

You agree not to use our website, services, or creative materials for fraudulent, unlawful, abusive, or unauthorized purposes.

We reserve the right to modify our services, availability, and website content as business operations evolve.

SECTION 2 — SERVICES & PURCHASES

Destined Design Agency specializes in professional creative services, including brand identity development, website design, booking website development, graphic design, promotional materials, product packaging, email marketing design, and monthly creative retainers.

Each service includes specific deliverables, requirements, pricing, and estimated turnaround times outlined within its individual service description.

Clients are responsible for reviewing all information before purchasing.

Purchasing a service does not automatically guarantee immediate project commencement.

The Agency reserves the right to decline requests that fall outside its professional capabilities, availability, or established service offerings, subject to applicable law.

SECTION 3 — PAYMENTS & BILLING

All services require full payment upfront before production begins unless an alternative arrangement has been expressly approved in writing.

A payment receipt or confirmation will be provided following a successful transaction.

Clients agree to provide accurate billing information and authorize the applicable charges associated with their purchases.

Additional services, modifications, or requests outside the original scope of work may require separate payment.

Failure to satisfy outstanding payment obligations may result in project suspension or cancellation.

SECTION 4 — REFUNDS & CANCELLATIONS

Due to the customized and service-based nature of our work, payments are generally considered final and non-refundable once work has commenced, except where otherwise required by applicable law.

Refunds are not ordinarily provided for buyer's remorse, changes of mind, switching service providers, or decisions to discontinue a project after production begins.

Clients may request cancellation; however, cancellation does not automatically entitle the Client to reimbursement.

Any completed work, allocated resources, and services already performed may be compensated or retained in accordance with the applicable agreement and law.

Unfinished drafts, concepts, and preliminary creative materials remain the property of Destined Design Agency.

Nothing in this section limits any non-waivable legal rights or remedies.

SECTION 5 — PROJECT TURNAROUND TIMES

All project turnaround times are outlined within the respective service descriptions.

Turnaround times begin only after the Client has submitted all required information, completed design questionnaires, photographs, written content, and supporting materials.

Our standard business hours are:

Monday–Thursday | 12:00 PM–8:00 PM Eastern Time

Major holidays are excluded from regular business operations.

Rush services may be available for an additional fee.

Delays caused by missing materials, incomplete submissions, late responses, or changes to the original scope of work may extend the estimated completion date.

SECTION 6 — CLIENT RESPONSIBILITIES

Clients agree to provide complete, accurate, and timely information necessary for project completion.

This includes relevant business information, photographs, written content, branding materials, and access to required platforms.

Clients must ensure they possess the appropriate rights and permissions to use all materials submitted for design purposes.

Destined Design Agency is not responsible for delays resulting from incomplete submissions or failure to respond to project communications.

SECTION 7 — REVISIONS & ADDITIONAL SERVICES

Revision allowances vary according to the selected service or package.

For applicable website development services, five edits per page are included unless otherwise stated.

Additional website edits beyond the included allowance are subject to a $50 fee per edit.

After website completion and release, additional requested modifications are billed separately.

The standard turnaround for eligible website edit requests is approximately three business days.

Requests for complete redesigns, new creative concepts, or additional deliverables may require separate payment.

SECTION 8 — BRANDING PACKAGES & CREATIVE RETAINERS

Branding packages are sold as complete service packages and cannot be divided, substituted, or modified without written approval.

Clients must provide the required information for every included deliverable.

Monthly creative retainers are governed by their respective package descriptions and service agreements.

Retainer clients are responsible for submitting design requests and necessary materials within the applicable service period.

Additional deliverables exceeding the selected monthly allowance may incur separate fees.

Renewal, cancellation, and unused design allowance policies are governed by the individual retainer agreement.

SECTION 9 — WEBSITE DEVELOPMENT & THIRD-PARTY SERVICES

Clients purchasing website development services are responsible for obtaining and maintaining their own domain names, website subscriptions, and any required third-party accounts.

Destined Design Agency may utilize platforms such as Shopify, Wix, Acuity Scheduling, Klaviyo, and other external providers.

We are not responsible for third-party platform outages, subscription charges, technical restrictions, or policy changes beyond our reasonable control.

Ongoing website maintenance, modifications, and technical support following project completion are not included unless expressly stated within the selected service.

SECTION 10 — INTELLECTUAL PROPERTY & OWNERSHIP

All original concepts, drafts, creative direction, preliminary designs, and unfinished materials developed by Destined Design Agency remain the intellectual property of the Agency unless otherwise agreed in writing.

Clients receive the ownership or usage rights expressly specified for final approved deliverables upon completion of the applicable payment and project obligations.

Editable source files, copyright transfers, and exclusive ownership rights are provided only when expressly included within the purchased service or written agreement.

Unauthorized reproduction, redistribution, resale, or commercial use of Agency-owned materials is prohibited.

SECTION 11 — ARTIFICIAL INTELLIGENCE & CREATIVE INTEGRITY

Destined Design Agency maintains standards for protecting its original creative work and professional design services.

Clients may not submit Agency-owned preliminary concepts, drafts, or other protected materials into artificial intelligence platforms for modification, recreation, generation, or reinterpretation without prior written authorization.

AI-generated materials must not be used in a manner that infringes the Agency's intellectual property rights or violates an applicable service agreement.

Unauthorized use or modification of protected materials may result in project suspension, termination, or other remedies available under the applicable agreement and law.

SECTION 12 — COMMUNICATION POLICY

All project-related communication must be conducted directly with the paying Client unless another authorized representative has been approved.

Please allow approximately 24–48 hours for general email responses during business operations.

Clients requesting project updates should allow approximately 12–24 hours for a response.

When contacting the Agency regarding an existing order, Clients should include their order number in the email subject line.

SECTION 13 — PROFESSIONAL CONDUCT

Destined Design Agency maintains a zero-tolerance policy regarding harassment, threatening behavior, and abusive or unprofessional communication.

The Agency may enforce a three-strike procedure involving an initial warning, removal of an offending individual from project communications, and termination of services for continued misconduct.

Serious violations may warrant immediate action.

Any termination, refund eligibility, and remaining contractual obligations will be handled in accordance with the applicable service agreement and law.

SECTION 14 — CHARGEBACKS & PAYMENT DISPUTES

Clients are encouraged to contact Destined Design Agency directly regarding billing concerns or service-related disputes.

If a chargeback or payment dispute is initiated after work has commenced, the Agency may suspend project activity while the matter is reviewed.

An unresolved material payment dispute may result in termination of services where permitted by the applicable agreement and law.

Destined Design Agency reserves the right to provide relevant contracts, invoices, project communications, and proof of completed work to payment processors or financial institutions.

Nothing in this section restricts lawful payment dispute rights.

SECTION 15 — WEBSITE CONTENT & PROHIBITED USES

All original website content, graphics, written materials, branding elements, and Agency-owned designs are protected by applicable intellectual property laws.

You agree not to reproduce, distribute, resell, or commercially exploit protected website materials without authorization.

You may not use our website to transmit malicious software, engage in fraudulent transactions, interfere with website functionality, or violate applicable laws.

SECTION 16 — ACCURACY OF INFORMATION

We make reasonable efforts to ensure that service descriptions, pricing, and website information are accurate.

However, typographical errors, technical inaccuracies, or omissions may occasionally occur.

Destined Design Agency reserves the right to correct inaccuracies and update information as necessary.

If a material error affects a confirmed purchase, the Client will be notified and any resulting adjustment or cancellation will be handled in accordance with applicable law.

Our website may contain links to external websites, applications, and services that are not owned or controlled by Destined Design Agency.

We are not responsible for the content, privacy practices, policies, or operation of independent third-party websites.

SECTION 18 — DISCLAIMER OF WARRANTIES

Services are provided according to the specifications and obligations established within the applicable service agreement.

Destined Design Agency does not guarantee particular sales results, revenue increases, customer engagement, or business growth arising from the use of its creative services.

To the extent permitted by law, we disclaim warranties not expressly provided within an applicable written agreement.

Nothing in this section excludes warranties or rights that cannot legally be disclaimed.

SECTION 19 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Destined Design Agency shall not be liable for indirect, incidental, or consequential losses arising from circumstances beyond its reasonable control.

This includes third-party platform interruptions, external software failures, or business losses not directly attributable to a breach of an applicable legal obligation.

Nothing in these Terms of Service limits liability that cannot lawfully be excluded.
